2017 Amendments To The Act

The Housing Legislation (Building Better Futures) Amendment Act 2017 (PDF, 1.3MB) was passed by Parliament on 25 October 2017 and assented to on 10 November 2017. It contains amendments to the Manufactured Homes (Residential Parks) Act 2003 (the Act) (PDF, 975KB).

There are several processes for resolving disputes between a home owner and a park owner in a residential park. Your residential park owner may have an internal dispute resolution process.

The residential park owner sets the rules about the use, enjoyment, control and management of the park. Park rules might include:

Residential Parks Utilities

In most cases, utilities in residential parks are not included in the site rent. These are generally paid for separately by the home owner to the park owner. Park owners cannot charge more for the supply of a utility to residents than the actual cost charged to the park owner by their supply authority.

Site Fees

The site fees, which are listed in the site agreement and payable on a regular basis such as weekly or fortnightly. You may be eligible to receive some rental assistance from Centrelink depending on your circumstances.

The Park Committee

A residential park can have one home owners' committee. The committee is formed by an election organised by home owners of the park. There usually is about 5 – 8 members.

Home Owners Responsibilities

As a home owner, you have obligations that are imposed both by the Act and your site agreement. As a resident under a site agreement you must:

Responsibilities Of The Park Owner And Manager

Residential parks are managed by a park owner or manager.  The park owner for a residential park may appoint a person as the park manager, with responsibility for the day-to-day management of the park.

If you are buying a manufactured home and plan to live in a residential park, the park owner/manager of the residential park must supply you with the following documents:

Information about the Home Assist Secure program for Queenslanders aged 60 years and over, or people of any age with a disability, which provides safety related information, referrals and subsidised assistance to eligible clients unable to undertake or pay for critical maintenance services without assistance.
